Terms of Service

The agreement between you and CipherPathway.

Effective Date: May 25, 2026

These Terms of Service ("Terms") govern your use of cipherpathway.com and all products offered by Richard Glenn Clark, doing business as SmartestDesk ("CipherPathway," "we," "us," or "our"). By purchasing or accessing any CipherPathway product, you agree to these Terms. If you do not agree, please do not purchase or access the products.

1. What We Sell

CipherPathway publishes original preparation materials for the CompTIA Security+ SY0-701 certification exam. Products currently include:

• The Field Manual — a digital, in-browser content review manual (gated, watermarked, no download)
• The Practice Exam — a 120-item full-length scored diagnostic simulation
• The Complete System — The Field Manual and The Practice Exam together

2. Independence and Trademark Acknowledgments

CipherPathway is an independent preparation resource. CipherPathway is not affiliated with, endorsed by, or sponsored by CompTIA, the Computing Technology Industry Association, or any certification body. The Security+ exam and the SY0-701 exam objectives are the property of CompTIA. CompTIA® and Security+® are trademarks of CompTIA. All other product names, logos, and brands referenced anywhere on this site are the property of their respective owners.

3. License Grant

Subject to your full payment and continued compliance with these Terms, CipherPathway grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the purchased materials for your own individual exam preparation only, for the duration of your access window:

• The Field Manual: 60 days from date of purchase
• The Practice Exam: 60 days from date of purchase
• The Complete System: 90 days from date of purchase

Access is licensed to you, the purchaser, and is bound by access code to a maximum of two device fingerprints. Codes cannot be reset, transferred, or shared.

4. What You Agree NOT To Do

• Share, redistribute, sell, sublicense, or transfer your access code or any portion of the materials to any other person
• Copy, screenshot, photograph, print, screen-record, or otherwise reproduce the materials in any form
• Attempt to bypass the access gate, the device fingerprinting, or any other technical protection
• Use the materials to train any machine-learning model, retrieval system, or commercial derivative product
• Use the materials for any purpose other than your own individual exam preparation
• Falsely represent that CipherPathway materials are official CompTIA materials

5. No Guarantee of Passing

CipherPathway makes no guarantee, representation, or warranty that use of our materials will result in a passing score on the Security+ exam or any other examination. Preparation outcomes depend on factors specific to each candidate including prior experience, study time invested, exam-day performance, and many factors outside our control.

6. Refund Policy

All sales are final after access is activated. Access is considered activated the moment your access code is delivered to the email address provided at checkout. If you believe access was activated in error or your code was never delivered, email support@cipherpathway.com within 14 days of purchase for review.

7. Disclaimers and Limitation of Liability

The materials are provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, CipherPathway’s aggregate liability arising out of or related to your use of the materials shall not exceed the amount you paid for the specific product giving rise to the claim.

In no event shall CipherPathway be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or examination failure costs.

8. Intellectual Property

All content on the CipherPathway site and in the Field Manual, the Practice Exam, and supporting materials — including text, layout, design, code, exam questions, and explanatory rationales — is original work copyrighted by Richard Glenn Clark, d/b/a SmartestDesk. All rights reserved. No portion may be reproduced, distributed, or transmitted in any form or by any means without prior written permission.

9. Privacy

Your use of the site is also governed by our Privacy Policy, which describes what data we collect, how we use it, and your rights.

10. Governing Law

These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-law principles. Any dispute arising under or related to these Terms shall be resolved exclusively in the state or federal courts located in Shelby County, Tennessee.

11. Changes to These Terms

We may update these Terms from time to time. Updated Terms are effective when posted on this page. Continued use of the products after an update constitutes acceptance of the revised Terms.
